Model Municipal By-law

The Covering Brief

Read this before the By-law itself

What this document is

Ten pages explaining what the model by-law is, why it exists, and what it deliberately leaves unfinished. If you only read one of the two documents, read this one.

The By-law itself is 87 pages of drafting. The Brief is the argument behind it: the problem a municipality is actually facing, why subjective noise language keeps failing when it reaches a court, and what an objective framework would have to do instead.

It is also where the limits are stated plainly, including the questions that belong to a licensed acoustic practitioner rather than to a drafter.

Then the By-law

Once the Brief has set out the problem, the By-law itself provides the instrument: sound standards, hours, siting, barriers, equipment, permits, commissioning, existing courts and enforcement, in a form a municipality can lift from.
